1. The NorthernGo Service

NorthernGo offers an AI-driven platform for generating and hosting web applications. By using our service, you agree to these terms. We reserve the right to suspend accounts that abuse the service or generate illegal content.

2. Data Processor (Our default database)

By default, your apps use NorthernGo's built-in Supabase database (PostgreSQL, EU). When you, as a user (data controller), collect data via this database, NorthernGo acts as a data processor for that storage. We process it only to keep your app running and do not share it with unauthorized parties. Your NorthernGo account (email, profile, project metadata) is stored in Google Firebase, which may process data outside the EU/EEA under the EU Standard Contractual Clauses. By accepting these terms, we enter into a data processing agreement under GDPR art. 28 for the default database. The full agreement is at https://northerngo.com/dpa/. You remain solely responsible for your end-users' rights, including erasure and access requests from your app's data.

3. Custom Database, Export & Payments (Stripe)

You have the option to connect your own external database, connect external webhooks, or use your own Stripe API keys to accept payments in your generated apps. When you use these features, the responsibility transfers entirely to you.

• Data Privacy: Data is sent directly from your app to your external database. NorthernGo has no insight, saves no history, and does NOT act as a data processor for the data flowing through your own connections.
• Security: NorthernGo does not perform backups of data stored in your own connected database. It is your responsibility to ensure that necessary security measures are in place.
• Payments & Stripe: If you use the Stripe integration to accept payments in your app, you are legally responsible for your own customers, refunds, and terms. NorthernGo facilitates the connection to Stripe but NEVER processes, sees, or stores your customers' credit card information.

4. Use of Third-Party AI

To generate and debug code in cloud mode, your prompts, any uploaded sketch or file, and relevant code are sent to Google Gemini via API. We do not train our own models on your content. Google's processing is governed by their API terms. In local mode (WebGPU or Ollama), text prompts and generated code do not leave your device — except image generation and document uploads, which still go via the cloud.

5. Local AI & WebGPU

Text generation via WebGPU or Ollama runs on your device. Text prompts and generated code in that mode do not leave your computer. Image generation, document uploads and cloud mode still go via Google Gemini. WebGPU models are downloaded to your browser cache on first use. It is your responsibility to ensure the device has storage space and supports WebGPU.

6. Intellectual Property Rights

The code and applications generated via NorthernGo belong to you as the user. You have full rights to download, export, and publish them wherever you want. NorthernGo retains ownership of the underlying platform and AI architecture.

7. Payment, Right of Withdrawal & Failed Payments

For our paid subscriptions (Premium/Pro), the cost is deducted in advance. Since NorthernGo is a digital service delivered and usable immediately upon purchase, you explicitly agree that the service begins execution immediately and that you thereby waive your statutory 14-day right of withdrawal (within the EU). You can cancel or manage your subscription at any time via your account settings before the next billing period.

In the event of a failed payment, our payment provider (Stripe) will automatically make retry attempts to process the charge over the following days. Reminder emails and payment notifications regarding the failed transaction will be sent out automatically by Stripe to your registered email address.

8. Limitation of Liability

NorthernGo is provided "as is". We do not guarantee that generated code is bug-free from the start. It is your responsibility to test applications before putting them into production. We are not liable for any loss of income caused by downtime.

9. Cloud Storage in User-Generated Apps (BaaS)

When you as a user (Pro/Premium) create apps via NorthernGo that collect, store, or manage data from your own end users, the following division of responsibility applies:

• Your role as Data Controller: You are solely responsible for all data collected via the apps you create. It is your responsibility to ensure you have a legal basis (e.g., consent) for the collection.
• Our role as Data Processor: NorthernGo only provides the technical infrastructure (the cloud database). We only process the data for the purpose of keeping your app running and do not share it with unauthorized parties.
• Prohibition of sensitive data: It is strictly forbidden to use NorthernGo's built-in cloud databases to store extra sensitive personal data (e.g., medical information, social security numbers, or financial card details).
